Terms and Conditions:
Please note that Netcom Online Learning is part of Netcom Training LTD
1.1. The definitions in this clause apply in the Terms and Conditions based in this document.
“Course” means any course, module or units of study of learning purchased from Netcom Online learning (Netcom Training).
“Course Fees” means the cost of the course, the amount payable from the student to Netcom Training for the service provided.
“Course Materials” means all the materials (online learning, mentoring, virtual labs, PDFs) that has been provided by Netcom Training or any of our course providers to the student.
“Course Provider” means any course designer/ manufacturer who delivers and provides online tutoring and support.
“Credit Agreement” means a loan that has been agreed between the student and the lending partners.
“Enrollment” means signing up on a course.
“Enrollment Date” means the date that the student has enrollled on the course and has been confirmed by Netcom Training.
“Default in payment” means that two or more payments are overdue under the Credit Agreement or Netcom Training under the instalment option of payments.
“Intellectual Property Rights” means patents, rights to inventions, copyright and related rights, trade marks, business names and domain names, rights in get up, goodwill and the right to sue for passing off, rights in designs, database rights, rights to use and protect the confidentiality of confidential information. This includes know how, and all other intellectual property rights in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of and rights to claim priority form, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
“Interest Free” means that no interest will be charged on the course fee according to the Credit Agreement.
“Lending Partner” means Netcom Training or any other lending institution that has been accounted by Netcom Training.
“Online Learning System” means an online system that has been provided by one of Netcom Training’s course providers in order to deliver, mentor and support the students.
“Order” means an agreement by the student to purchase a course with Netcom Training.
“Registration” means an official enrollment with Netcom Training.
“Service” means the authorization of any course by Netcom Training or any of our course providers.
“Student” means a person that has purchased a course and has a unique username and password and is working towards a certification or qualification.
“Terminate” means to rule out a Credit Agreement and demand full payment of all amounts due.
“Terms” means the Terms and Conditions in this document.
“Netcom Training” means Netcom Training ltd- Company Number 07678031
“Netcom Training Website” means www.netcomonlinelearning.co.uk
1.2 References to “we”, “us”, and “our” are references to Netcom Training and Netcom Online learning.
1.3 Reference to “you”, “your”, or “yourself” is reference to a person or firm who purchases a service from Netcom Training.
1.4 Reference to clause is to a clause of the terms above
2.1 The description of the services is as set out in Netcom Online learning’s website, catalogues, brochures, or any other form of advertisement. Any description is for illustrative purposes only.
2.2 All courses which appear on Netcom Online learning’s website are subject to availability.
- Personal Information
3.2 We may contact you by using email or by phone.
3.3 Netcom Training will only share the student’s personal information with third parties where the law required them to do so.
- Basis of Sale
4.1 The terms and conditions include the entire agreement between the student and Netcom Training to provide the specific services.
4.2 The student must ensure that the order confirmation is complete and accurate and inform Netcom Training immediately of any errors. Netcom Training is not responsible for any inaccuracies in order placed by the student. If there has been a mistake, the student must notify Netcom Training in writing. Netcom Training only accepts responsibility made in writing.
4.3 By agreeing to these terms and conditions, the student agrees that they have not relied on any statements that have been given to them on behalf of Netcom Training which is not specified in this document.
4.4 No variation of the order can be made regarding fees or otherwise after it has been purchased unless the variation is agreed by the student and Netcom Training in writing.
4.5 The student agrees and confirms that they are merely responsible that they possess the necessary and suggested skills and experience required to register on a specific course.
4.6 Netcom Training has the right to amend or revise these terms and conditions periodically. The student will be subject to any privacy that has been placed in the terms at the time that they have placed and ordered for our services unless any changes of these terms are required by law or government or regulatory authority in which case it will apply to orders previously placed that Netcom Training has not yet completed.
5.1 Netcom Training is responsible for providing training or for contracting a third party to provide the online services and is free to choose any course provider for such purposes. Netcom Training is entitled to transfer the duties of contract to a third party to perform and change contents of training sessions if the objective of the training is not compromised.
5.2 Netcom Training will make every effort to provide the student with all important knowledge during online training.
5.3 The students will receive a certificate confirming their completion on a specific subject.
- Consumer Rights
6.1 Once the student has logged into Netcom Training’s learning system using the login details sent by Netcom Training, they acknowledge receipt of service received. This process invalidates the student’s cancellation rights under current consumer regulations.
6.2 The student cannot cancel any course provided by Netcom Online learning once they have logged in to the course and the maximum extent permitted by law. Netcom Training has no liability to provide a refund for the course fees paid in whole or partially.
6.3 The student has the right to cancel payment instalments any time within 14 days from the date that the first payment has been made.
6.4 For any cancellation to enrollment, the student must inform Netcom Training in writing, using the email: firstname.lastname@example.org
6.5 If you cancel your course even if you have logged on the online learning platforms if you have not downloaded any course materials including any resource files or watched more than one minute of video material as indicated by our records, you will be able to cancel your course within 7 days of purchase. This is the maximum extent permitted by law, Netcom Training has no liability to provide the student with a refund for fees paid.
6.6 If cancellation has been agreed between Netcom Training and the student, the student will receive a refund of the course fees paid. Netcom Training will make refunds within 30 days of receipt of the student’s written notification.
- Students with Disability
7.1 Netcom Training cannot supply any computers, tablets, software or equipment for a student with disability. Netcom Training will provide students with information about exam bookings regarding any special needs on the exam centres’ premises.
8.1 Any communication or notice in connection with Netcom Training’s terms and conditions must be in writing either sent to the company’s address provided to you or by email.
- Third Party Rights
9.1 A person who is not a party to the terms and conditions will not have any rights to enforce the terms.
- Delivery of Course Materials
10.1 Netcom Training will send an email to the student after the payment has been processed successfully within 5 business days to provide login details to the online portal. Once the login details have been sent to the student, he/she may start their online training course.
10.2 Netcom Training has the right to make any changes to the services provided which is necessary to comply with any applicable law.
- Student’s Obligation
11.1 The student must ensure that the terms of their order are complete and accurate to their best of knowledge
11.2 Any changes to the student’s details must be reported to Netcom Training by writing, these could be changes of address, phone number, email address, bank details, change of name, or any changes in the student’s circumstances that might affect their training.
11.3 Netcom Training has the right to suspend the course or performance of the services until the student has remedied the default payment.
11.4 Netcom Training is not liable for any costs or losses that has been incurred by the student whether directly or indirectly from their failure or delay to perform any of the obligation set in this clause.
11.5 The student will not reveal personal login details to any other party.
- Course Fees and Registration
12.1 All course fees include VAT, however, if the VAT rate changes, we will adjust the new rate to the courses when the student makes a purchase. This will not affect any students that have already made a full payment on their course.
12.2 All course fees are subject to change.
12.3 Course fees cover all course materials as outlined in the course description.
12.4 Full payments of courses must be made in advance before starting the course if the student wants to get the discount on full upfront payment by credit or debit card in accordance with the Continuous Payment Authority. Netcom Training accepts payments with Visa, Visa Debit, Master Card, PayPal and bank transfer.
12.5 Netcom Training currently accepts payments by direct debit mandate.
12.6 Netcom Training will charge an unpaid instalment fee of 20 pounds for each instalment or direct debit missed.
12.7 Netcom Training has the right to terminate the agreement by giving you written notice if you fail to pay the instalments.
12.8 Course materials and course fees do not include examination fees, awarding bodies registration or special materials.
12.9 Different courses will have different methods of assessment which could be online assessment, submission of written assessments, exam simulator or a combination of them. Netcom Training reserves the right to change the mode of assessment at any time based on the course provider’s needs. Any changes made to your course will be notified to you within reasonable time.
12.10 The student is solely responsible for any costs or expenses related to running and accessing the course material. Netcom Training will provide support regarding the method and specifications that are needed for your training to work without error.
12.11 Netcom Training does not provide refund on discounted courses or special offers.
- Transferring Course Material to Someone Else
13.1 When the student purchases a course from Netcom Training, they are provided with a unique username which is only to be used by the specific person.
13.2 Course materials should not be transferred to any other person that the person on receipt of the registration email.
14.1 Course materials are protected by copyright and are intended only for the student’s learning purposes.
14.2 The student may store the course materials in electronic form. However, the course material should not be stored on any server or any other storage devices connected to a network.
14.3 The student will be responsible for any loss that Netcom Training suffers if the student uses or copies the course materials other than in accordance with our terms and conditions.
14.4 The student must not publish, copy, transmit, translate, broadcast, sell or produce or distribute any of the course materials.
14.5 The course materials that have been provided to the student might contain license agreement from other parties than us. The student’s enrollment is subject to the student’s compliance with any applicable license agreement.
15.1 The student is obliged to keep confidential all business and company secrets made known to him/her during training. This obligation is not limited to the training period. The student may not share these with a third party or use them for his/her own purposes without written permission from Netcom Training.
15.2 Netcom Training and the student undertakes that they shall not at any time disclose to any person any confidential information concerning business, affairs, customers, clients or suppliers of the other party, except by clause 3.3
15.3 Each party may disclose the other party’s confidential information, to its employees, subcontractors or advisers that need to know such information for the sole purpose of carrying out obligations under the contract. Or if the information is required by law, a court of jurisdiction or any government or regulatory authority. Or with the written permission of the other party.
15.4 Neither of the parties shall use the other party’s confidential information for any purpose other than to perform its obligations under the terms and conditions set out.
16.1 The student must obtain prior written permission from Netcom Training to transfer all rights stipulated in the contract.
16.2 The law of England and Wales, applies for all claims arising from the contract.
16.3 Changes and supplement to these terms and agreements must be specified in writing to serve as point in controversy.
16.4 Netcom Training and the student irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute which might come out in connection with the contract. This includes non-contractual claims and disputes.
17.1 No variation, including the introduction of any additional terms and conditions shall be effective unless it is agreed in writing and signed by Netcom Training unless it is stated in these terms.
18.1 A waiver of any right or remedy is only effective if given in writing to Netcom Training and shall not be deemed a waiver of any subsequent breach or default. A delay or failure to exercise or the single or partial exercise of any right or remedy shall not waive that or any other right or remedy and not prevent or restrict the further exercise of that or any other right or remedy.
